We assisted a local occupier during the leasehold acquisition in 2009 of a 100,000 sq ft distribution warehouse and offices.
The property was a mixture of 1970’s and 1980’s linked warehouses, which were in a pretty poor state of repair.
We undertook and prepared a detailed schedule of condition of the property to limit the tenant’s future dilapidations liability.
This included all internal areas, external fabric, external areas and boundaries to the site. The schedule was agreed with the Landlord’s surveyors.
We also advised the client in connection with their obligations to undertake certain repair and improvement works, which formed part of the deal.
Subsequently in 2013 we advised the client following a break option on dilapidations and successfully negotiated cash settlements with both the Landlord and by then a sub-tenant.
